Work-Site Posting Update

TASB work-site posters are being updated to incorporate recent changes to the U.S. Equal Employment Opportunity Commission (EEOC) employee rights notice and the Office of Injured Employee Counsel (OIEC) program notice.

The TASB Federal and State Work-Site Postings for Texas Public Employers are expected to be available for purchase in the TASB Store by January 2023. Districts will be able to purchase new posters in the TASB Store to replace posters that were last updated in 2016.

Federal Poster Update

The new EEOC released poster, “Know Your Rights: Workplace Discrimination is Illegal” (dated October 20, 2022), replaces the previous “EEO is the Law” poster. Covered employers are required by federal law to prominently display the poster at their work sites. The EEOC’s poster web page provides information about where to post it. The poster also includes a QR code for applicants or employees to link directly to instructions for how to file a charge of workplace discrimination with the EEOC.

The poster summarizes laws enforced by the EEOC and explains that employees and applicants can file a charge if they believe that they have experienced discrimination. Information about discrimination based on the following are included in the poster:

  • Race, color, sex (including pregnancy and related conditions, sexual orientation, or gender identity), national origin, religion
  • Age (40 and older)
  • Equal pay
  • Disability
  • Genetic information (including family medical history or genetic tests or services)
  • Retaliation for filing a charge, reasonably opposing discrimination, or participating in a discrimination lawsuit, investigation, or proceeding

State Notice Update

In August, the OIEC updated the Ombudsman Program notice. All employers participating in the Texas workers’ compensation system must post “Employer’s Notice of Ombudsman Program” in the personnel office and in the workplace where each employee will regularly see the notice. The amended version must be posted in English, Spanish, and any other language that is common to the employer’s employees. OIEC rules require the notice be printed with a title in at least 15-point bold type and text in at least 14-point normal type. The TASB State Work-Site Poster for Texas Public Employers will include the required text in the prescribed format.

Replacing Your Posters

The EEOC has not announced a deadline for replacement of the federal notice but states that employers should swap out their postings as soon as possible. According to OIEC, employers should replace the state notice as soon as possible. If the notice is currently part of a labor law poster, it can be replaced when the employer receives the annual update.

Employers may wait to replace their posters in January when our worksite posters are available or download the new notices from the EEOC and OIEC websites and post these next to their existing posters. 

Keeping Up with Changes

HR Services will send a notice to all members with instructions for purchasing the new posters through the TASB Store as soon as they are available.
