Affordable Care Act Update
The U.S. Court of Appeals for the Fifth Circuit held that the Affordable Care Act (ACA) individual mandate is unconstitutional but stopped short of declaring the ACA unconstitutional in its entirety.
The case has been remanded to the district court to provide more specific recommendations for the remaining parts of the law. Until the district court makes any decisions, all provisions of the ACA other than the individual mandate remain enforceable, and employers and plan sponsors should continue to comply with the ACA.
Other notable decisions include:
- Re-institution of the Patient-Centered Outcomes Research Institute (PCORI) fee for an additional 10 years
- Repeal of ACA taxes including the Cadillac Tax, the Medical Device Tax, and the Annual Fee on Health Insurance Providers
